•Power to cancel or vary registration and to rectify the register [s. 57]
–Cancel or vary the registration on the ground of
–Any contravention, or
–Failure to observe a condition entered on the register in relation thereto
•Absence/omission of any entry
•Entry made without sufficient cause
•Entry wrongly remaining on register
•And error or defect in the entry
•Correction of register [s. 58]
–Correct any error in the name, address or description of the registered proprietor of a trade mark,
–or any other entry relating to the trade mark
–Enter any change in the name, address or description of the person
–cancel the entry of a trade mark
–strike out any goods or classes of goods or services of a trade mark
–make any consequential amendment or alteration in the certificate of registration
•Alteration of registered trade marks [s. 59]
–May be altered if it does not substantially affect the identity of the trade mark
